Terms of Use
1. General provisions
1.1. These Terms govern the relationship between Fiberon LLC (the “Company”) and the individual who has requested use of the Fiberon Cloud cloud storage (the “User”).
1.2. The Service consists of the portal cloud.mon.az (registration, user account) and the cloud storage at drive.mon.az, which runs on the open-source Nextcloud software, as well as mobile and desktop applications.
1.3. By ticking the consent box at registration, the User confirms that they have read, understood and fully accept these Terms. The date, time, IP address and version of the accepted Terms are recorded.
1.4. A User must be at least 18 years old, or at least 14 years old with the consent of a legal representative.
2. Access to the Service
2.1. The Service is provided free of charge to members of the Company’s community. No fee is charged for its use.
2.2. Access is granted only after the email address is confirmed and the request is approved by an administrator. The Company may refuse access without giving reasons.
2.3. The storage size is determined by the selected and approved plan. Plan changes are requested from the user account and also require approval.
2.4. The Company strives to keep the Service running without interruption but, as it is provided free of charge, does not guarantee any specific level of availability. Scheduled maintenance may take place; the Company will give advance notice whenever possible.
3. User obligations
3.1. Provide accurate information at registration.
3.2. Keep the password and recovery codes secret and not share the account with third parties. All actions performed under the User’s account are deemed to be performed by the User until the User notifies the Company that access has been compromised.
3.3. Comply with the Acceptable Use Rules and the legislation of the Republic of Azerbaijan.
3.4. Make their own backups of especially important data. Cloud storage does not replace a personal backup archive.
4. Rights to content
4.1. All rights to files uploaded to the storage remain with the User. The Company acquires no rights to them.
4.2. The Company does not view the contents of storage, except where expressly required by law, in case of reasonable suspicion of a breach of the Acceptable Use Rules, upon a complaint from a rights holder, or at the request of an authorised public authority.
4.3. The User is solely responsible for the lawfulness of materials stored and shared via links.
5. Suspension and termination
5.1. The Company may suspend access in case of a breach of these Terms or the Rules, a threat to the security of the Service, or where required by law.
5.2. The Company may delete an account that has not been used for more than 180 days after notifying the User by email at least 14 days in advance.
5.3. Requests with an unconfirmed email are deleted after 7 days, rejected requests after 30 days.
5.4. The User may delete the account and all files at any time in the user account. Deletion is irreversible.
5.5. If the Service is discontinued, the Company will notify Users at least 30 days in advance so that they can save their data.
6. Liability
6.1. The Service is provided “as is”. To the maximum extent permitted by law, the Company is not liable for indirect damages, lost profits, or loss of data caused by actions of the User, third parties or force majeure.
6.2. The Company takes reasonable organisational and technical measures to protect data: encrypted connections, daily backups, access control and two-factor authentication.
7. Changes to the Terms
7.1. The Company may amend these Terms. The new version is published on this page; Users are notified of material changes by email at least 10 days in advance. Continued use of the Service after the changes take effect means acceptance of them.
8. Governing law and disputes
8.1. These Terms are governed by the legislation of the Republic of Azerbaijan.
8.2. Disputes are resolved through negotiation and, failing agreement, by the court at the Company’s location.
